 JZee Leeming Model & Casting Agency Terms & Conditions – CHILDREN

Definitions:

‘Agency’ refers to JZEE LEEMING LIMITED, a company registered in England and Wales under number 9248663  whose registered office is at Irish Square, St. Asaph, Denbighshire, LL17 0RN

‘Artiste(s)’ refers to the child registered with the Agency for all work including Photographic, TV, Film, Video, Voiceover, Stage, PR Assignments

‘Parent(s)’ refers to the parent/legal guardian in charge of the Artiste(s) and any person responsible for or accompanying the Artistes to an assignment

‘Client(s)’ refers to the Agency’s Client(s), which is the person(s)/company who employs the Artiste(s) via the Agency.

THE AGENCY

  1. Once registered with the Agency, the Agency will provide a “work finding” service to the Artiste for all modelling and acting work, including photographic, TV, Film/Video, Voiceover, Stage & PR assignments. Notice will be provided as soon as we are provided with information from the Client, which is usually at very short notice.
  2. The Agency will submit all Artiste(s) registered on their books for all suitable assignments, including photographic, TV, Film/Video, Voiceover, Stage & PR assignments. This therefore includes working as a model, actor, extra or performer.
  3. The Agency will ensure the Artiste has an individual, fully searchable web page on the Agency  website for Client’s perusal at all times during the 12 month contract between the Parent and Agency. The Agency will keep all the Artiste(s) details fully up to date, as supplied by the Parent.
  4. The Agency will contact the Parent to arrange bookings on behalf of the Artiste(s) as and when this occurs. Artiste’s payments can only be paid once the Agency has been paid by the Client, which can take up to 6 months (although all our invoices are sent to our Clients once the job is fully complete, subject to terms of 30 days). The Agency will pay the Artiste within 10 working days of receiving cleared funds into their account from the Client. The Agency cannot be held responsible for payment of monies owed to the Artiste by the Client if the Client goes into liquidation or withholds payments from the Agency for any reason.
  5. The Agency has the right to represent the Artiste and publish Artiste details, including images, in any promotional/advertising capacity without reference to the Artiste.  The Artiste agrees that any document, in any media, created, produced or published by the Agency may not be used by any other individual or company without prior written consent of the Agency.  The Agency agrees to represent the Artiste but cannot guarantee that the Artiste will receive any work as ultimately the final casting decision rests with the Client and not the Agency.  The Artiste hereby agrees that no representations have been made to them by the Agency that have given such a guarantee and, for the avoidance of doubt, the Artiste agrees that the Agency has not and will not charge the Artiste for representation during the term of this agreement.
  6. The Agency cannot and does not guarantee work for any Artiste that it represents.

COMMISSION STRUCTURE

  1.  EQUITY CONTRACT TV COMMERCIALS – All fees will be invoiced by the Agency. The Agency takes 25% commission from all fees. This excludes any travel costs, which are payable to the Artiste in full.
  2. OTHER – All fees will be invoiced by the Agency. The Agency takes 25% commission from all fees. This excludes any travel costs, which are payable to the Artiste in full.
  3. Parents or associates of the Artiste who undertake work on behalf of the Agency agree that a commission of 25% (plus VAT on that commission) will be deducted by the Agency from the gross fee for the assignment(s), that a charge of £1.00 plus VAT per cheque issued is applicable and that, in regard to the assignment(s), they are self-employed and are responsible for the declaration and payment of TAX and National Insurance that is due.

THE OBLIGATIONS OF THE PARENT

  1. The Parent agrees to contact the Agency on a regular basis (no less than every 3 months) with up to date measurements and photographs, where required.
  2. The Parent agrees to provide up to date photographs of the Artiste of a suitable quality as requested by the Agency. The Agency’s standards must be met and the Agency’s decision is final. Inappropriate and unsuitable photographs will not be used on the Agency’s website.
  3. Upon receipt of the Parent confirmation they wish the Artiste to join the Agency, the Agency will supply the Parent with a registration form to complete and return with payment, together with licensing documentation. The Parent agrees to return the completed licensing documentation within 28 days of receipt. The Parent will contact the Agency if they are unable to return the documents within 28 days. The Parent understands that without this documentation, the Artiste cannot work.
  4. The Parent agrees that it is the responsibility of the Parent to complete and return any forms, measurement sheets and licensing documentation forwarded by the Agency.  If the Artiste is not licensed as a result of the Agency not having been provided with the correct information or documents the Agency cannot promote or forward the Artiste for assignment(s) in any form.  The Parent agrees that it is the responsibility of the Parent to notify the Agency of any changes to their personal details to include (but not limited to) change of postal address, change of email address, telephone numbers, measurement details etc.  The Parent agrees to notify the Agency of any significant changes to the Artistes appearance including (but not limited to) change of hair style/colour, weight loss/gain, addition of piercings and understands that failure to inform the Agency of such changes may result in the Artiste being sent home from an assignment without any payment. The Parent agrees to update the images provided to the Agency should the Agency deem a significant change in the Artistes appearance has taken place.  The Parent agrees and accepts that if updated images have been requested but not provided the Agency cannot promote or forward the Artiste for assignment(s).
  5. The Parent confirms that the Artiste is legally entitled to work in the United Kingdom when undertaking an assignment and understands the Agency will not promote an Artiste who has not provided the Agency with relevant documentation. The Parent agrees that the Agency may, in capacity of data controller (The Data Protection Act 1998) share the Artiste’s personal data with third parties, handle, hold and process data about the Artiste in order to process primary and residual payments as necessary and, in compliance with statutory requirements, report information to Her Majesty’s Revenue and Customs (HMRC) and relevant child employment legislation authorities.
  6. The Parent agrees to:
    1. Ensure that the Artiste arrives on time for all arrangements, Bookings
    2. Ensure that the Artiste is accompanied by a responsible adult at all times during a Booking, unless specifically agreed otherwise with the Agency.
    3. Limit the amount of people attending the Booking with the Artiste to 1-2 adults only and no additional children, unless otherwise agreed with the Agency.
    4. Ensure that the Artiste behaves in a polite and professional manner during Bookings.
    5. Contact the Agency immediately in the event of the Artistes illness or any other emergency situation which prevents the Artiste from attending a Booking.
    6. Ensure the Artiste attends the Booking with clean hair, face, nails and clothing, as per the booking confirmation details.
    7. Ensure a job record which is provided by the Agency is fully completed on the day of a booking and returned to the Agency no more than 3 working days after the booking has taken place, otherwise the Artiste may not receive payment for their work.
    8. Ensure that they, or the Artiste, do not display poor or rude conduct towards the Agency’s staff and other children, Parents or Clients. This would include inappropriate correspondence to the Agency, or reference to the Agency by a Parent/Artiste to any third party.
    9. The Parent agrees that the Agency has the right to terminate this agreement and its representation of the Artiste with immediate effect should an Artiste or any person representing the Artiste fail to behave in a professional and courteous manner towards, and during any communication with, the Agency and or Agency staff.

GENERAL

  1.  The Agency has the right to terminate this agreement if the Parent fails to comply with the provisions of clauses detailed above, whereby the Artiste will be removed from the Agency’s website and the Agency’s books completely, with immediate effect.
  2. Should a Parent wish to terminate their contract with the Agency and remove the Artiste from the Agency’s books, written confirmation must be received by the Agency from the Parent. The Artiste details will then be removed within 3 working days from receipt of such correspondence. The Artiste details will be kept on file for 12 months from the date of removal, after which they will be permanently deleted. The Agency cannot be approached regarding any details relating to an Artiste file after this time, as the file would have been deleted.
  3. The Parent/Artiste confirms it is not the responsibility of the Agency to ensure the safety of the Artiste whilst undertaking any assignment(s).  The Artiste agrees to comply with all rules and regulations, including those pertaining to Health & Safety, that are in place at the Agency and at any premises or location where any assignment(s) is undertaken. The Parent/Artiste confirms that the Agency cannot be held responsible or liable for any injury or accident that may occur to the Artiste when travelling to or from or during any assignment(s) they undertake on behalf of the Agency.  The Parent/Artiste confirms that they are responsible for travel arrangements to and from the location of the assignment and that the Artiste must meet any expenses incurred when undertaking an assignment unless otherwise stated by the Agency.
  4. Information on all assignments undertaken by any Artiste with the Agency (including venue, Client name and contact details, dates, fees, requirements etc) are kept for a period of 6 years with the Agency, after which time they are permanently deleted.
  5. The Agency’s decision is final.
  6. By signing these terms and conditions, the Parent acknowledge that they authorise the Agency to act on the Parent and the Artiste’s behalf. This includes the Agency receiving monies on the Artiste’s behalf.
  7. The Agency reserves to the right to change their terms and conditions at any time, giving the Parent/Artiste notification of this.

The Parent/Artiste agrees that they will not without prior written consent from the Agency make public any information in connection with the business of the Agency or these Terms & Conditions.  The Parent/Artiste agrees that any details regarding assignment(s) work, paid or un-paid, undertaken by the Artiste will not be divulged to the press/radio or any media or posted on any social networking site or public forum without written consent of the Agency.   The Parent/Artiste agrees that if they are deemed by the Agency to have divulged any details regarding assignment(s) work, paid or un-paid to the press/radio or any media, or posted on any social networking site or public forum, the Agency has the right to terminate this Agreement.

 

JZee Leeming Model & Casting Agency Terms & Conditions – ADULT

Definitions:

‘Artiste(s)’ refers to the Adult registered with the Agency for all work including Photographic, TV, Film, Video, Voiceover, Stage, PR Assignments

‘Client(s)’ refers to the Agency’s client(s), which is the person(s)/company who employs the Artiste(s) via the Agency.

THE AGENCY

  1. Once registered with the Agency, the Agency will provide a “work finding” service to the Artiste for all modelling and acting work, including photographic, TV, Film/Video, Voiceover, Stage & PR assignments.   6. The Agency cannot and does not guarantee work for any Artiste that it represents.
  7. The Agency will provide their own Agency photographer at a current rate is £65 inc VAT. This will only be offered to an Artiste once fully registered for 30 days or more. The Agency will send the Artiste a separate document outlining full details on the photography service provided if requested, once the Artiste have been registered with the Agency for this period.

COMMISSION STRUCTURE

  1. The Artiste agrees that the Agency acts as an employment agency and grants the Agency sole authority to negotiate and collect, on behalf of the Artiste, all gross income arising from any assignment(s) negotiated by the Agency throughout the term and in perpetuity.  The Artiste agrees the following:
    1. EQUITY CONTRACT TV COMMERCIALS – All fees will be invoiced by the Agency. The Agency takes 25% commission from all fees. This excludes any travel costs, which are payable to the Artiste in full.
    2. OTHER – All fees will be invoiced by the Agency. The Agency takes 25% commission from all fees. This excludes any travel costs, which are payable to the Artiste in full.
    3. A charge of £1.00+VAT per cheque issued is applicable.
    4. No refunds or rebates are payable on commission fees.
    5. The Artiste recognises and agrees that the Client is the employer therefore payment for an assignment(s) can only be made to the Artiste on receipt of payment by the Client to the Agency.
    6. The Artiste understands that the Agency will raise a commission invoice if the Artiste is paid any fee directly by the Agency’s client and that representation may be suspended until the commission invoice is paid in full by the Artiste.
    7. The Agency cannot be held responsible for payment of monies owed to the Artiste by the Client if the Client goes into liquidation or withholds payments from the Agency for any reason.  The Artiste acknowledges that they take on any assignment sourced by the Agency on a self-employed basis and that they are solely responsible for declaration and payment of any Tax and National Insurance, if applicable, that may be due and this is not the responsibility of the Agency.  Associates of the Artiste who undertake work on behalf of the Agency agree that a commission of 25% (+VAT on that commission) will be deducted by the Agency from the gross fee for the assignment(s), that a charge of £1.00+VAT per cheque issued is applicable and that in, regard to the assignment(s), they are self-employed and are responsible for the declaration and payment of Tax and National Insurance that is due.

The Artiste agrees that it is the responsibility of the Artiste to complete and return any forms, measurement sheets and any other required documentation forwarded by the Agency.  The Artiste agrees that it is the responsibility of the Artiste to notify Agency of any changes to their personal details to include (but not limited to) change of postal address, change of email address, telephone numbers, measurement details etc.  The Artiste agrees to notify the Agency of any significant changes to their appearance including (but not limited to) change of hair style/colour, weight loss/gain, addition of any tattoos/piercings and understands that failure to inform the Agency of such changes may result in the Artiste being sent home from an assignment without any payment. The Artiste agrees to update the images provided to the Agency should the Agency deem a significant change in the Artiste’s appearance has taken place.  The Artiste agrees and accepts that if updated images have been requested but not provided the Agency cannot promote or forward the Artiste for assignment(s).
  4. The Artiste agrees that the Artiste is legally entitled to work in the United Kingdom when undertaking an assignment and understands that the Agency will not actively promote an Artiste who has not provided the Agency with acceptable photographic identification and National Insurance number or relevant work permit.  The Artiste agrees that the Agency may, in the capacity of data controller (The Data Protection Act 1998) share the Artiste’s personal data with third parties, handle, hold and process data about the Artiste in order to process primary and residual payments as necessary and, in compliance with statutory requirements, report information to Her Majesty’s Revenue & Customs (HMRC).
  5. The Artiste agrees to:

    3. Contact the Agency immediately in the event of any illness or any other emergency situation which prevents the attendance at any booking.

    5. Ensure a job record which is provided by the Agency is fully completed on the day of a booking and returned to the Agency no more than 3 working days after the booking has taken place, otherwise they may not receive payment for their work.
    6. Ensure they do not display poor or rude conduct towards the Agency’s staff and other Artistes or Clients. This would include inappropriate correspondence to the Agency, or reference to the Agency by the Artiste to any third party.
    7. The Agency has the right to terminate this agreement and its representation of the Artiste with immediate effect should an Artiste or any person representing the Artiste fail to behave in a professional and courteous manner toward, and during any communication with the Agency and/or Agency staff.

The Artiste agrees that they shall not without prior written consent from the Agency make public any information in connection with the business of the Agency or these Terms & Conditions.  The Artiste agrees that any details regarding assignment(s) work, paid or un-paid, undertaken by the Artiste will not be divulged to the press/radio or any media or posted on any social networking site or public forum without written consent of the Agency.   The Artiste agrees that if they are deemed by the Agency to have divulged any details regarding Assignment(s) work, paid or un-paid to the press/radio or any media, or posted on any social networking site or public forum, the Agency has the right to terminate this Agreement.
  9. The Artiste confirms that these Terms and Conditions may not be copied or reproduced.

 

JZee Leeming Model & Casting Agency Terms & Conditions – CLIENT

Definitions:

Agency: JZEE LEEMING LIMITED, a company registered in England and Wales under number 9248663 whose registered office is at Irish Square, St. Asaph, Denbighshire, LL17 0RN.

Client: The individual, person or company requesting the services of an Artist in accordance with JZee Leeming Limited Terms and Conditions for Clients.

Artist: The person who is booked to provide Services to the Client in accordance with JZee Leeming Limited Terms and Conditions for Clients.

Conditions: The terms and conditions as set out in the JZee Leeming Limited Terms and Conditions for Clients and any special terms that have been agreed by all parties in writing prior to a Booking taking place.

Services: The services to be provided by the Artist as specified to the Client in accordance with JZee Leeming Limited Terms and Conditions for Clients.

Contract: The contract for the provision of the Service.

Booking: The date and time that Services are to be provided by the Artist as specified to the Client in accordance with JZee Leeming Limited Terms and Conditions for Clients.

Client Directory: The on-line publication that hosts Artist Profiles.

Artist Profile: Information on the Artist, as submitted to the Agency by the Artist, consisting of images, personal data and any relevant information that is posted on the Client Directory.

Regulations: The Conduct of Employment Agencies and Employment Business Regulations 2003 & The Conduct of Employment Agencies and Employment Business (Amendment) Regulations 2010.

All Clients should read the following terms and conditions carefully before proceeding to book an Artist under representation by JZee Leeming Limited as, in the event of booking an Artist, you will be deemed to have accepted the JZee Leeming Limited Terms and Conditions for Clients and agree to be bound by them.  No change to these Terms & Conditions will be binding unless agreed in writing by the Agency.

Conditions:

  1. JZee Leeming Limited Terms and Conditions for Clients shall apply to any Contract.
  2. No variation to these terms will be binding on the Agency or Artiste other than any special terms that have been agreed in writing by all parties prior to a Booking taking place.
  3. No representations made by the Agency’s employees concerning the Contract, Artist, Services or Booking will be incorporated into a Contract unless confirmed in writing.
  4. The Agency will give the Client access to the Client Directory to view the Artist Profiles as required in the procurement of Services.  Any error or omission on the Artist Profile or documentation issued by the Agency shall be subject to correction by the Agency without any liability on the part of the Agency.
  5. The Client shall only access the Client Directory for the authorised purpose of viewing Artist Profiles with the genuine intent to request Services if the Artist meets their needs.  The Client shall not allow access to the Client Directory to unauthorised users, including Artists.

Acknowledgements & Agreements:

    1. The Client acknowledges and agrees that the Agency is an employment agency.
    2. The Client acknowledges and agrees that the Agency is authorised by the Artist to negotiate and agree the Contract on behalf of the Artist.
    3. The Client acknowledges and agrees the Agency will make every effort to ensure that the Artist will provide Services in accordance with the Conditions and accepts that the Agency is not liable for any default of the Artist under any Contract.
    4. The Client agrees to provide the Agency with all relevant information, including information required to facilitate compliance with the Regulations, in connection with the Contract, Artist, Services or Booking and to comply with obligations under the Data Protection Act 1998.
    5. The Client acknowledges and agrees that they are responsible for ensuring that adequate insurance cover to underwrite their obligations to the Artist is in place prior to the commencement of any booking and if required, will provide the Agency with a copy of the said insurance.
    6. The Client agrees to make available facilities as reasonably required by the Artist prior to and during a Booking and to maintain public liability insurance and other such insurances as may be appropriate to the Contract, Artist, Services or Booking.
    7. The Agency agrees to provide the Client with all relevant information, including information required to facilitate compliance with the Regulations, in connection with the Contract, Artist, Services or Booking and to comply with obligations under the Data Protection Act 1998.
    8. The Agency agrees to inform the Client at the earliest reasonable opportunity of any event that may affect the provision of Services by the Artist.
    9. The Agency agrees to inform the Client at the earliest reasonable opportunity of any special facilities that may be required by the Artiste.

Fees, Rates & Permitted Purpose – Still Photography Model Bookings:

Minimum booking time is 1hour.  Discounted half day rates (4hours) and full day rates are available but MUST be pre-booked.  Normal rates will apply to bookings between normal working hours of 09.00hours and 18.00hours.

  1. Provisional bookings will be automatically cancelled if they are not confirmed within 24 hours of the proposed booking or if a definite booking is offered to the same Artist for the same time that the provisional booking cannot be confirmed.
  2. Weekend rates will be applied outside Monday- Friday, 09.00-18.00hours and Overtime rates will be applied on all bookings over 8 hours in duration:
    1. Saturday, an hourly rate 1.5 times the normal rate will be applied plus overtime as required.
    2. Sunday, an hourly rate 2 times the normal rate will be applied plus overtime as required.
    3. Bank Holiday, an hourly rate 2 times the normal rate will be applied plus overtime as required.
    4. Between 18.00-24.00hrs an overtime rate 1.5 times the applicable normal rate will be applied.
    5. Between 24.00-09.00hrs individual, Booking specific rates will be negotiated prior to the Booking taking place.
  3. Travel rates/expenses (if applicable) will be negotiated at the point a Booking is made.
  4. Additional rates may be charged for casting and fitting appointments.
  5. Unless previously agreed in writing before the Booking takes place the permitted use of any photographic image is limited to the initial permitted use as agreed by the Contract for one year from the date of the Booking.  It is the Client’s responsibility to notify the Agency that additional fees may be due to ensure permitted use.
  6. Additional fees are payable for the right to use the images (including reproductions, adaptations, drawings there from, either in complete or in part, alone or in conjunction with any word or drawings, including electronic imaging of the photographic image) for anything other than the initial permitted use (including but not limited to swing tickets, posters, packaging, press) or for additional periods of time.  Additional fees will be specifically negotiated depending on the anticipated use and duration of use of the image.
  7. Exclusion Fees.  A special fee will be negotiated when the work is in conjunction with a product that precludes work for competing products.  It is the Clients responsibility to check and advise the Agency whether or not an exclusion fee is required.  An Artist shall be able to work for any Client unless an exclusion fee has been paid in full.
  8. Test & Experimental Photography. A Client is not entitled to use test and/or experimental photographs for commercial purposes unless specific arrangements have been made in writing with the Agency prior to the test Booking.
  9. Payment of fees and rates of pay is required 30 days from the date of invoice.  A 10% credit charge per month may be added to all invoices not settled within agreed payment terms.  In all cases the Client responsible for commissioning the session will be invoiced, and be solely responsible for payment unless otherwise agreed in writing at the time of Booking.  All fees are for the right to use pictures and, once agreed, are payable whether or not the use is appropriated.  All fees quoted are for the U.K. only – unless otherwise agreed when a Booking is made. Where payment for title to photographic images or performance (or any adaptation of photographic images or performance) has not been made within agreed payment terms the Agency reserves the right to invoice the Client.

Fees, Rates & Permitted Purpose – TV, Film, TVC, Telegraphic Modelling:

  1. Booking rates for the Services provided by an Artist will be individually negotiated prior to any Booking taking place.
  2. Provisional bookings will be automatically cancelled if they are not confirmed within 24hours of the proposed booking or if a definite booking is offered to the same Artist for the same time that the provisional booking cannot be confirmed.
  3. Overtime, Weekend and Bank Holiday rates will be individually negotiated prior to any Booking taking place.
  4. Travel rates/expenses (if applicable) will be negotiated at the point a Booking is made.
  5. Additional rates may be charged for casting and fitting appointments.
  6. Unless previously agreed in writing before the Booking takes place the permitted use for broadcast is limited to the initial permitted use as agreed by the Contract.  It is the Client’s responsibility to notify the Agency that additional fees may be due to ensure permitted use.
  7. Additional fees are payable for anything other than the initial permitted use or for additional periods of time.  Additional fees will be specifically negotiated depending on the anticipated use and duration of use.
  8. Exclusion Fees.  A special fee will be negotiated when the work is in conjunction with a product that precludes work for competing products.  It is the Clients responsibility to check and advise the Agency whether or not an exclusion fee is required.  An Artist shall be able to work for any Client unless an exclusion fee has been paid in full.

Postponements & Cancellations:

  1. If a Client postpones a Booking within 24 hours of the previously agreed start time the full fee, as agreed, may be charged unless the same model is re-booked within 24 hours in which case half the agreed fee may be charged.  If the Client then cancels the postponed Booking the Client shall pay the balance of the full fee. These postponement fees may be incurred at the discretion of the Agency.
  2. If a Client cancels a Booking within 24 hours of the previously agreed start time the full fee, as agreed, may be charged unless the same model is re-booked within 24 hours in which case half the agreed fee may be charged. If a booking is cancelled outside the one day period but within two working days of the starting time, 50% of the fee may be charged. Bookings of more than 3 days duration:  If the booking is cancelled within a period equal to the length of the booking, then half the fee may be charged. These cancellation fees may be incurred at the discretion of the Agency.
  3. If an Artist needs to postpone a Booking the Agency will advise the Client at the earliest, reasonable opportunity.  The Agency shall not be liable to the Client for any loss incurred, directly or indirectly, as a result of the Booking postponement by the Artist.
  4. If an Artist needs to cancel a Booking the Agency will advise the Client at the earliest, reasonable opportunity.  The Agency shall not be liable to the Client for any loss incurred, directly or indirectly, as a result of the Booking cancellation by the Artist.
  5. The Agency shall not be liable to the Client for any loss incurred, directly or indirectly, as a result of any Artist failing to attend a Booking or providing appropriate Services.  nor will the Client pursue the Artist (or the Artist’s parent/legal guardian) for any loss incurred, directly or indirectly, as a result of any Artist failing to attend a Booking or providing appropriate Services.
  6. If the Client has notified the Agency that a Booking is a weather permitting booking and fails to contact the Agency in reasonable time (as agreed at the time of booking) to advise the Agency that the Booking is cancelled to prevent the Artist attending the full fee may be payable.

Liabilities:

  1. Neither the Artists or the Agency shall be liable in respect of any default arising from the Client’s negligence or abnormal working conditions.
  2. The Agency will make every reasonable effort to ensure that the Artist is able to carry out the Services required by the Client but the Agency is not liable for any failure on the part of the Artist in any regard including, but not limited to, absence, punctuality, ability, conduct and failure to perform.
  3. The Agency will not be under any liability for any failure by the Artist to provide the Services.
  4. The Artist, Agency or Client shall not be liable for any delay or failure to perform resulting from or due to any act of war, act of God, strike, industrial action, fire, flood, drought, natural disaster or any other event beyond the reasonable control of either party.
  5. The Client is responsible for the Artist safety whilst providing any Service in connection with the Booking.  It is the Client’s responsibility to ensure that all relevant legislation is adhered to for the duration of the Booking including, but not limited to, Health & Safety standards.

General:

  1. All parties agree that the Artist is self-employed and shall be responsible for payment of National Insurance and/or Income Tax to HMRC
  2. The headings in the Conditions should not affect their interpretation.
  3. The Client shall not expose, reveal or make public any information about the Agency or the Conditions as any information and the Conditions are to be regarded by all parties as strictly confidential.
  4. Any cause for complaint should be reported to the Agency when it arises.  Complaints cannot be considered in retrospect.  The Agency is not responsible if the Artist fails to complete a Booking to the Client’s requirement and/or satisfaction.
  5. The Client must adhere to the legislation in accordance with the ‘Children & Young Person Acts 1933 & 1963’ and the ‘Children (Performances) Regulations 1968’ at all times and is solely responsible for the Artist’s welfare whilst they are providing Services in connection with the Booking.
  6. JZee Leeming Ltd reserves the right to negotiate within the structure of the Conditions.
  7. The Conditions and any Contract or agreement with the Client to which the Conditions apply shall be governed by the laws of England and Wales and are subject to the exclusive jurisdiction of the English and Welsh Courts.
